Commercial Electronic Message Consent / Explicit Consent Text

I consent to being contacted by Faboglobal.com for the purpose of promoting new products/services and campaigns, and to receiving commercial electronic messages via email, SMS, and voice calls. In this context, I give permission for the phone number I have shared with the FABO Makina website to be transferred to the SMS and email service provider.

FABO Global, as the “data controller” within the scope of the Personal Data Protection Law No. 6698 regarding the personal data of users of the website faboglobal.com, provides this Clarification Text to inform our users in accordance with the relevant law and regulations.

Purpose of Processing Personal Data:

The personal data of users are processed by https://faboglobal.com/ within the scope of the personal data processing conditions and purposes stated in Articles 5 and 6 of the Personal Data Protection Law No. 6698, including but not limited to the following purposes:

  • To carry out necessary work by relevant business units to enable individuals to benefit from the products and services offered by https://faboglobal.com/, and to manage the related business processes;
  • To carry out necessary work by relevant business units for the execution of commercial activities conducted by our website and to manage related business processes;
  • To plan and execute FABO’s commercial and/or business strategies;
  • To ensure the legal, technical, and commercial-operational security of https://faboglobal.com/ and the relevant parties in a business relationship with FABO;
  • To plan and execute the activities required to customize and promote the products and services offered by https://faboglobal.com/ according to the preferences, usage habits, and needs of the relevant individuals.

Transfer of Personal Data

Personal data of users may be shared, within the scope of the personal data processing conditions and purposes specified in Articles 8 and 9 of the Law No. 6698, with company authorities, our business partners, legally authorized public institutions and organizations, and private entities, for the following purposes:

  • To carry out necessary activities by relevant business units to enable individuals to benefit from the products and services offered by the FABO website, and to manage related business processes;
  • To carry out necessary activities by relevant business units for the execution of commercial activities conducted by https://faboglobal.com/ and to manage related business processes;
  • To plan and execute FABO Global’s commercial and/or business strategies;
  • To ensure the legal, technical, and commercial-operational security of faboglobal.com and the relevant individuals in a business relationship with faboglobal.com;
  • To plan and execute activities necessary to customize and promote the products and services offered by faboglobal.com according to the preferences, usage habits, and needs of the relevant individuals.

User’s Consent Regarding the Matter

In the cases listed in Article 5, Paragraph 2 of Law No. 6698, personal data may be processed without the explicit consent of users. Accordingly,

  • Explicitly Stipulated by Law
    It is not necessary to obtain explicit consent from users in the following cases, as stated in Article 5, Paragraph 2 of Law No. 6698:

    • If it is explicitly stipulated by law.
    • If it is necessary to protect the life or physical integrity of a person who is unable to give consent due to actual impossibility or whose consent is not legally valid, for themselves or another.
    • If it is necessary to process the personal data of the parties to a contract, provided that it is directly related to the establishment or performance of the contract.
    • If it is necessary for the data controller to fulfill their legal obligation.
    • If the personal data has been made public by the individual concerned.
    • If it is necessary for the establishment, exercise, or protection of a legal right.
    • If it is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the individual.

    In these cases, explicit consent from users is not required. The service that users will receive under the FABO website membership agreement falls within the scope of Article 5, Paragraph 2(c) of Law No. 6698.

    Method and Legal Basis for Collecting Personal Data:
    Personal data is collected electronically from users. The personal data collected based on the legal grounds mentioned above may be processed and transferred for the purposes stated in Articles 5 and 6 of the Law and in this Clarification Text.

Rights of Users as Personal Data Owners:

In accordance with Article 11 of Law No. 6698, data subjects (users) have the following rights:

  • To learn whether personal data concerning them is being processed,
  • If personal data has been processed, to request information about it,
  • To learn the purpose of processing personal data and whether it is being used in line with that purpose,
  • To know the third parties to whom personal data is transferred domestically or abroad,
  • If personal data has been processed incompletely or inaccurately, to request its correction and to request that the correction be notified to third parties to whom the personal data has been transferred,
  • Even if personal data has been processed in accordance with the law and other relevant legislation, to request the deletion or destruction of personal data if the reasons for processing no longer exist, and to request that the deletion or destruction be notified to third parties to whom the data has been transferred,
  • To object to any result that is to their detriment arising from the analysis of personal data exclusively through automated systems,
  • To request compensation in case of damage due to unlawful processing of personal data.

Requests regarding the exercise of these rights can be communicated to FABO via the email address or call center listed on our contact page. Our company will evaluate and conclude your request within 30 days.

GENERAL EXPLANATIONS

Under the Personal Data Protection Law No. 6698 (“KVKK Law”), individuals defined as data subjects (hereinafter referred to as the “Applicant”) are granted the right to make specific requests regarding the processing of their personal data under Article 11 of the Law.

In accordance with Article 13/1 of the KVKK Law, applications concerning these rights must be submitted to FABO Global, the data controller, in writing or via other methods determined by the Personal Data Protection Board (“Board”).

It is important that the personal data we hold about you is accurate and up to date. Therefore, please notify us if there are any changes to your personal data. Within the framework of the KVKK Law and related regulations, you may:

  • Learn whether your personal data is being processed,
  • Request details about the data we have collected,
  • Learn the purposes for which your data is collected and how it is used, as well as the third parties to whom your personal data has been transferred within or outside the country,
  • Request correction or updating of your personal data if it is incomplete or incorrect, or request deletion if the reason for processing no longer exists, including notification to third parties to whom the data was transferred.

Within this scope, written applications to us can be made by printing out this form and sending it in an envelope with the note “Personal Data Protection Law Information Request” written on the envelope or in the subject line.

The application may be submitted to us through the following methods:
