What is personal data, and who processes it?

Pursuant to Article 3 of the Law on the Protection of Personal Data No. 6698 (“KVKK Law”), personal data refers to any information relating to an identified or identifiable natural person. FABO MAKİNA İMALAT PAZARLAMA SANAYİ VE TİCARET LTD. ŞTİ. (“Company”), in its capacity as “data controller” pursuant to the KVKK Law, will record, store, update, process, disclose, and transfer your personal data to third parties in compliance with the KVKK Law.

For what purposes may your personal data be processed?

Your collected personal data (First Name, Last Name, Phone Number, Address, E-Mail Address);

May be processed for reasons such as fulfilling our Company’s legal obligations, carrying out necessary operational, legal, and/or business activities by our business units, being necessary for the performance of a contract, requirements of our Company’s legitimate interests, responding to inquiries in the contact form in the most accurate and expeditious manner, etc.,
Ensuring that activities carried out by our Company are conducted in accordance with relevant legislation and Company procedures, and executing audit and control activities,

for the reasons and purposes specified herein, in accordance with Article 4 of the KVKK Law.

To whom and for what purposes may your processed personal data be transferred?

Your personal data specified in Article 2 of this Privacy Notice may be transferred to Business Partners, natural persons, private legal entities, and legally authorized public institutions and organizations pursuant to Articles 8 and 9 of the KVKK Law, strictly limited to the fulfillment and realization of the purposes stated in the same article.

On what legal grounds, by which methods do we collect your personal data, and for how long do we retain it?

Your personal data in question is processed automatically based on the legal grounds set forth in Article 5 of the KVKK Law, namely: “data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject”, “it is mandatory for the data controller to fulfill its legal obligation”, and “data processing is mandatory for the establishment, exercise, or protection of a right”. Your processed data will be retained for the maximum duration specified in the relevant legislation or required for the purpose of processing, and in any case for the statutory limitation periods; upon expiration of these periods, it will be deleted, destroyed, or anonymized.

What are your rights under the Law on the Protection of Personal Data No. 6698?

Pursuant to Article 11 of the KVKK Law, you have the right to:

Learn whether your personal data is being processed,
Request information if your personal data has been processed,
Learn the purpose of processing your personal data and whether they are used in accordance with their purpose,
Know the third parties to whom personal data is transferred domestically or abroad,
Request rectification of personal data if it is incomplete or incorrectly processed, and request notification of this correction to third parties to whom the personal data has been transferred,
Request the erasure or destruction of personal data within the framework of the conditions stipulated in Article 7 of the Law (excluding statutory limits), and request notification of this erasure and destruction to third parties to whom personal data has been transferred,
Object to an outcome against you arising from the analysis of processed data exclusively through automated systems,
Claim compensation for damages arising from the unlawful processing of your personal data.

ŞTİ., acting in its capacity as data controller, pursuant to Article 10 of KVKK Law No. 6698 and the Communiqué on the Principles and Procedures to be Followed in Fulfilling the Obligation to Inform, in order to inform you regarding the purposes of processing your personal data, legal grounds, methods of collection, to whom it may be transferred, and your rights under the KVKK Law.
